TERMS AND CONDITIONS OF SALE AND USE

The website www.joywears.ma (hereinafter referred to as “JOYWEARS” or the “Site”) is an online sales website operated by B & E, with its registered office located at Boukhalef, Tangier, Morocco.

PREAMBLE

JOYWEARS offers on its website www.joywears.ma an e-commerce service allowing buyers (hereinafter referred to as “Buyers” or “You”), either registered or as “guests,” to purchase various products (hereinafter “Products”) offered at fixed prices.

These Terms and Conditions of Sale (hereinafter referred to as “T&Cs”) govern all transactions made on the JOYWEARS website. Any order placed on this Site implies full and unconditional acceptance of these T&Cs without reservation.

Accessing and/or using the Site also implies acceptance and compliance with all the terms outlined in these T&Cs. Therefore, these T&Cs form a contract between JOYWEARS and the Buyers. If the Buyer does not wish to accept all or part of these T&Cs, they are requested to refrain from using the Service.

PURPOSE

This remote contract aims to define the rights and obligations of the parties regarding the sale of JOYWEARS Products over the Internet through the website www.joywears.ma.

The T&Cs are divided into three sections:

1. General Terms of Use of the Site
2. General Terms of Sale for Buyers
3. Data Privacy Policy

I – GENERAL TERMS OF USE OF THE SITE

1.1 – Access to the Service

The Service is accessible free of charge to any User with internet access. All costs related to access (hardware, software, internet subscription, etc.) are solely the responsibility of the User, who is fully responsible for the proper functioning of their computer equipment and internet access.

Access to the Service is possible either by creating an account or using the “guest” mode. Any individual who is at least 18 years old and legally capable can register on the Site. When creating an account, you agree to provide accurate information and to notify JOYWEARS of any changes (via contact@joywears.ma).

In the event of false information or failure to update your details, JOYWEARS reserves the right to deactivate your account or deny access to the Service immediately and without notice.

1.2 – Service Pricing

Creating an account and using the Service are free of charge (excluding potential internet connection costs) and do not require any purchase on the Site. Only the purchase of Products is chargeable, as defined in these T&Cs.

1.3 – Service Availability

JOYWEARS will make every effort to ensure the availability of its services and error-free transmissions. However, due to the nature of the internet, this cannot be guaranteed. Your access to JOYWEARS services may be suspended or limited for maintenance, security, or to introduce new features.

JOYWEARS will strive to minimize the frequency and duration of such suspensions or limitations.

1.4 – Personal Data Protection

JOYWEARS is committed to implementing all necessary means to protect your personal data. Details can be found in the Privacy Policy.

1.5 – Intellectual Property

All texts, comments, illustrations, works, and images reproduced or represented on the Site are strictly reserved under copyright law and intellectual property rights, worldwide and for the legal duration of these rights. As such, only private use is authorized. Any reproduction, representation, modification, or adaptation, whether total or partial, of the Site or its elements is strictly prohibited.

The trademarks, domain names, logos, and distinctive signs displayed on the Site are protected. Any reproduction or use of these signs in any way, without prior written authorization from JOYWEARS, is strictly prohibited.

1.6 – Hyperlinks to Third-Party Sites

The Site may contain hyperlinks to third-party websites not controlled by JOYWEARS. Consequently, JOYWEARS cannot be held responsible for the content of these third-party websites and does not guarantee any satisfaction from their products or services.

However, if a User informs JOYWEARS that a link directs to illegal content, JOYWEARS commits to removing this link as soon as possible.

1.7 – Reviews, Blogs & Forums

When JOYWEARS provides a blog, forum, or review space, it reserves the right not to publish or to delete any content that is contrary to the law, public decency, or these T&Cs. Furthermore, anyone who posts content (reviews, testimonials, comments) agrees that JOYWEARS may use it for advertising or other purposes, without compensation.

1.8 – JOYWEARS Liability

JOYWEARS strives to verify the accuracy of the information on its Site but cannot guarantee its completeness, legality, or absolute accuracy. JOYWEARS cannot be held responsible for direct or indirect damages related to the use of the Site, inability to use it, or alteration of transmitted data.

1.9 – Modification of T&Cs

JOYWEARS reserves the right to modify its Site, procedures, and T&Cs at any time. The applicable T&Cs are those in force at the time you place your order. You will be informed of significant changes by email. If you continue to use the Site after the modification, you accept these new conditions.

1.10 – Governing Law and Jurisdiction

These T&Cs are governed by Moroccan law. Any disputes relating to their interpretation and/or execution fall under the jurisdiction of Moroccan courts.

II – GENERAL TERMS OF SALE FOR BUYERS

2.1 – Placing an Order

To purchase one or more Products on www.joywears.ma:

1. Select the desired items and add them to your cart.
2. View your cart and check the details of your order (products, prices, potential delivery fees).
3. Choose your delivery options and payment method.
4. Confirm the order.

A confirmation email will be sent to you. A second email will notify you of the shipment of your items.

JOYWEARS reserves the right to limit the quantities of the same product ordered by a single Buyer if it exceeds reasonable personal use.

2.2 – Product Availability

Product offers are valid as long as they are visible on the Site and within the limit of available stock. If a product becomes unavailable after your order is confirmed, JOYWEARS will inform you as soon as possible (via email or phone) and offer you either an exchange or a cancellation of the unavailable product.

The unavailability of one item does not affect the validity of the entire order if other items are available.

2.3 – Pricing

Prices are indicated in Moroccan dirhams (MAD), inclusive of all taxes. JOYWEARS may change its prices at any time; however, Products are billed based on the rates in effect at the time of order confirmation.

Total amounts include any applicable delivery fees, which are clearly indicated before final confirmation.

2.4 – Payment Methods

Payments can be made using the following method:

• Cash on Delivery (COD)

The Buyer guarantees they have the necessary authorization to use the chosen payment method. Online payments, if offered, are secured by approved payment service providers.

2.5 – Proof of Transactions

Order confirmations sent by JOYWEARS and electronic records (possibly provided by payment service providers) serve as proof of the transactions between you and JOYWEARS.

2.6 – Delivery

Delivery Address: Any address of your choice specified when placing the order within Morocco.

Delivery Fees:

Delivery Times: 5 to 14 working days, depending on your location.

JOYWEARS will inform you in case of unusual delays. The delivery times are indicative and non-contractual.

Additional Costs: In case of errors in the address provided or repeated unavailability of the Buyer during delivery, resulting in a return or extra costs, these additional fees may be charged to the Buyer.

Delivery Delays: If delivery is delayed by more than 7 days, the Buyer may cancel the contract and request a refund for the undelivered product(s).

Delivery Reservations: In case of loss, damage, or delays, the recipient must issue written reservations with the carrier (on the delivery slip) and inform JOYWEARS within 48 hours. Without such reservations within this time frame, the delivery is considered compliant.

2.7 – Right of Withdrawal

In accordance with Moroccan law, you have a period of 7 days from the receipt of your order to exercise your right of withdrawal without having to provide a reason. To do so, contact us at contact@joywears.ma or via your personal account, if you are registered.

Products must be returned in new, unworn, unwashed condition, with their tags and in their original packaging, suitable for resale. Return costs will be covered by JOYWEARS only if the delivery error is attributable to JOYWEARS; otherwise, they are at the customer’s expense (unless otherwise provided by law).

The right of withdrawal does not apply to:

• Goods made to the Buyer’s specifications (personalized items).
• Goods that cannot be returned for hygiene or health protection reasons if they have been unsealed.

2.8 – Return Policy

JOYWEARS offers a return option within 5 days after delivery under the following conditions:

• Returns can be made for a store credit or a refund (based on your preference).
• Items must be unworn, unwashed, in their original condition, with intact tags. Return shipping costs are borne by the Buyer (unless the error is on our part).
• Personalized or sale items are not eligible for return.

2.9 – Warranty, Defective Products, and Complaints

If a product is defective or does not conform to your order, please contact us within 48 hours of receipt at contact@joywears.ma. After verification, a refund or exchange may be offered.

Refunds, if applicable, are processed within 7 business days after verification of the returned items.
